The Divorce Process
In Pennsylvania, the divorce process begins with filing a Complaint for Divorce with the court, stating the grounds for divorce.
Pennsylvania permits two types of divorce: A Divorce based on Fault Grounds and a Divorce based on No-Fault Grounds:
Fault Grounds (Contested Divorce)
In a fault-based divorce, the plaintiff must demonstrate they are the innocent spouse and prove the other spouse's fault led to the marriage's demise. Fault-based divorces require proof of fault grounds presented in Court at a hearing and can be more complex.
Grounds for Fault-based Divorce
- Adultery

- Cruel and barbarous treatment
- Bigamy
- Imprisonment for a crime
- Indignities
No-Fault Grounds (Uncontested Divorce)
In a no-fault divorce, neither party must prove fault.
Grounds for a No-Fault based Divorce
A Mutual Consent divorce requires both spouses to agree that the marriage is over, and consent to divorce after 90 days pass from the date the Defendant was served the Divorce Complaint.
Separation requires that the parties have been separated for at least one year.
Generally, No-fault divorces may be less costly and less time-consuming, however, if the parties have unresolved marital property division, spousal support/alimony and/or custody disputes, these divorces can become high conflict and take as long as a Fault-based Divorce. That is why having an experienced Divorce attorney, who is both knowledgeable in the law and able to negotiate expeditiously the best outcome is imperative.
After filing the Divorce Complaint, the Plaintiff has a requirement to serve the Defendant commonly within 30 days, and the Defendant has 20 days to respond. The parties will then engage in discovery, exchanging financial information and other relevant documents. After the discovery period is over and there remains custody, child support, or property division disputes and the parties cannot come to an agreement, court intervention would be necessary to finalize the divorce case and resolve all unresolved disputed matters.
Marital Settlement Agreements
A Marital Settlement Agreement is a contract between the parties which is filed with the Court outlining the parties’ asset(s) and debt(s) and their distribution according to the parties’ Agreement. Marital Settlement Agreements may benefit the parties in their Divorce proceedings by expediting the Divorce process, resolving the disputed issues and alleviating the couples’ stress. The Agreements give couples control over the terms of their marital assets and liabilities and a clear understanding of their post-divorce responsibilities, instead of leaving the decisions to the Court. Marital Settlement Agreements are also cost effective by reducing litigation expenses and Court time. Once all disputed claims are resolved, a final divorce decree will be issued, officially ending the marriage.
Prenuptial Agreement
A prenuptial agreement, also known as a premarital agreement, is a legally binding contract entered into by couples before marriage. It outlines the division of assets, debts, and financial responsibilities in the event of divorce or death. A prenup can address issues such as property ownership, spousal support, and inheritance rights. By establishing clear guidelines, couples can protect their individual assets, minimize potential conflicts, and ensure a smoother divorce process, if needed. Prenups are particularly beneficial for individuals with significant assets, business interests, or children from previous relationships.
Postnuptial Agreement
A postnuptial agreement, also known as a postmarital agreement, is a legally binding contract created after marriage. It serves a similar purpose to a prenuptial agreement but is often used when circumstances change during the marriage. Some of the Postnups terms can address issues concerning the parties division of property acquired during marriage, spousal support/alimony, debt responsibility, business ownership, inheritance rights, and changes in financial priorities.
